2019 Hokulia Hawaiian Trip Sweepstakes

Official Rules

1. NO PURCHASE NECESSARY.

Sweepstakes offered only in the United States. Open only to legal residents of the United States 18 years or older. Potential winners may be required to provide proof of legal U.S. residency if requested by Sponsor to determine eligibility and as a condition of prize award. Sweepstakes offered at participating locations only. Sweepstakes begins on 5/1/2019 and ends at 11:59 PM Mountain Daylight Saving Time on 9/30/2019. Employees, Board Members, Directors of Hokulia Franchising, Inc., Hokulia Franchising, Inc.’s franchisees, their respective parents, affiliates and subsidiaries, fulfillment and/or promotion agencies, their immediate families (parents, siblings, children, spouse) and members of the same household of such employees (whether related or not) are not eligible to enter the Sweepstakes or win a prize. Sweepstakes void where prohibited by law.

2. ENTRY.

Provide cellular phone contact information at any participating Hokulia Shave Ice Shack. Once contact information is received, entrant will be directed to a website to complete an entry form. This entry form must be fully completed to enter the sweepstakes. Thereafter, each time a purchase is made, entrant will automatically be given an additional opportunity to win. All entries must be submitted by 11:59 PM Mountain Daylight Saving Time on September 30, 2019. 3. ENTRY WITHOUT PURCHASE.

Submit a mail-in entry without making a purchase at a Hokulia Shave Ice shack by mailing legibly written on paper your name, address, email address, and age along with a legible written self-addressed, stamped envelope with sufficient postage and a return address, including first and last name, street address, city, state, and ZIP code to: Hokulia Hawaiian Trip Sweepstakes, 872 W. Heritage Park Blvd., Suite 110, Layton, Utah 84041. Each mail-in entry will be given one chance to win. Mail-in entries must be postmarked by September 30, 2019.

4. ENTRY VALIDATION.

At some time prior to the RANDOM DRAWING it may be necessary for entrants to fill out an official entry form. Completing this form will aid the sponsor in determining the eligibility of potential winners.

5. RANDOM DRAWING:

On or about November 1, 2019, a random drawing will be conducted from among all eligible entries received to award the Hawaiian Trip for Four (as described below). The potential winner will be notified by telephone, postal mail, email and/or express mail, at Sponsor’s sole discretion. Potential winners will be required to execute and return an affidavit of eligibility, liability release and, unless prohibited by law, publicity release within seven (7) days of date of issuance. Inability to contact the potential winner within a reasonable time period, the return of prize notification as undeliverable, the failure to return required documents within the time period specified or noncompliance with these Official Rules will result in the prize being forfeited and, at Sponsor’s discretion, the prize may be awarded to an alternate winner. Odds of winning depend on the number of eligible entries received.

6. (1) PRIZE:

Airfare for four to Honolulu, Hawaii, 4 nights accommodations for four, and a $200 spending card. The determination of any tax liability resulting from the awarding of this prize is solely between the Sweepstake winner and the taxing authority. The responsibility for and payment of any taxes resulting from the awarding of this prize is the sole responsibility of the Sweepstake winner.

7. GENERAL:

The entrant is the individual whose name and contact information was provided to the shack and whose name is most commonly associated with the use of the number. Entry must have been done by the entrant and not by another person or by any automated software or program. Where legal, acceptance of prize constitutes winners’ permission to use his/her name, likeness, biographical information and photograph for advertising/publicity purposes. Any and all rights to said use, without notice or further compensation, is also agreed to, unless prohibited by law. Entrant agrees that Hokulia Franchising, Inc., it’s parents and affiliates, it’s franchisees, their respective parents, affiliates and subsidiaries, fulfillment and/or promotion agencies, all employees, officers and directors of each to release, discharge and hold harmless from any and all injuries, liability, losses and damages of any kind resulting, directly or indirectly, in whole or in part, from their participation in the sweepstakes or their acceptance, use or misuse of the prize (including any travel or activity related thereto) including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy; as a result of entrant’s and winners’ participation in Sweepstakes. In the event that, in the sole opinion of Sponsor, the Sweepstakes is not capable of being conducted as originally planned due to events beyond the Sponsor’s control, Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Sweepstakes. In such event, winner will be determined from among all entries received up to the termination date. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes; to be in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Sponsor is not responsible for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, or misdirected entries. Entrants give express authorization to be contacted by the sponsor for promotional purposes.

8. WINNER:

For winner information send a self-addressed stamped envelope before 11/1/19 to: Hokulia Hawaiian Trip Sweepstakes Winners, 872 W. Heritage Park Blvd., Suite 110, Layton, Utah 84041. Winner’s names will be posted on social media.
