Welcome to hokuliashaveice.com (the “Site”), operated by Hokulia Inc and its affiliates, including Hokulia Franchise Opportunities, LLC and franchise locations operating under the Hokulia Shave Ice brand (collectively, “Hokulia,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, joining our loyalty rewards program, or subscribing to our text message program, you agree to these Terms of Use. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access to any systems, scrape or harvest data, or use the Site in any way that violates applicable law.

2. Online Orders, Shop, and Catering

Purchases made through our online shop and catering requests are subject to product availability and confirmation. Prices are shown in U.S. dollars and may change without notice. We reserve the right to refuse or cancel any order, in which case any amount charged will be refunded. Shipping timelines are estimates, not guarantees.

3. Loyalty Rewards Program

Customers may enroll in the Hokulia loyalty rewards program at participating locations. Points and rewards have no cash value, are non-transferable, and may be modified or discontinued at any time. Enrollment in the loyalty program does not require agreeing to receive marketing text messages.

4. Text Message Program (Hokulia Text Club)

Hokulia offers a recurring text message program that delivers promotional offers, new flavor announcements, and loyalty rewards updates (“Text Club”).

How you opt in. You can join by (a) texting the keyword HOKULIA to (385) 666-6776, or (b) providing your mobile number and agreeing to receive promotional texts when enrolling in our loyalty rewards program at the register. Consent to receive marketing text messages is optional and is not a condition of any purchase.

Program details:

Message frequency varies; typically up to 4 messages per month.
Message and data rates may apply. Charges are billed by and payable to your mobile carrier.
You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation of your opt-out, after which no further messages will be sent.

Carriers are not liable for delayed or undelivered messages.
We may terminate or modify the Text Club at any time without notice.

5. Franchise Information

Information on the Site about franchise opportunities is for general purposes only and does not constitute an offer to sell a franchise. Franchises are offered only through delivery of a Franchise Disclosure Document in compliance with applicable federal and state law.

The Site and its contents — including the Hokulia name, logo, island design, images, menus, and text — are owned by or licensed to Hokulia and are protected by trademark and copyright law. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

If you submit reviews, photos, or other content to us or tag us on social media, you grant Hokulia a non-exclusive, royalty-free, perpetual license to use that content in our marketing. Do not submit content that is unlawful, infringing, or offensive.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOKULIA AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AND FRANCHISEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, THE TEXT CLUB, OR THE LOYALTY PROGRAM. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.
